This Product Safety & Use Disclaimer applies to Products sold by cutawaypoint and forms part of our Terms & Conditions.

1. Sports involve risk

Pickleball, sports, training, recreation, and physical activity involve inherent risks. These may include impact injuries, eye injuries, falls, slips, strains, sprains, collisions, equipment failure, misuse, sharp edges, property damage, and other personal or property injury. You accept these risks to the fullest extent permitted by law when using Products.

2. Inspection before use

Inspect all Products before each use. Do not use a Product if it appears cracked, broken, loose, worn, defective, distorted, sharp, unstable, damaged, contaminated, expired, or unsafe. Stop using a Product immediately if it changes shape, makes unusual sounds, loses fit, causes discomfort, shows lens damage, strap damage, edge damage, grip failure, or appears compromised.

3. Sold-out eyewear listing notice

IMPORTANT EYEWEAR NOTICE: Eyewear, if displayed on the Website, is intended to remain sold out and unavailable for purchase unless a specific Product page and checkout clearly allow purchase. A sold-out or unavailable eyewear listing is not an offer to sell that Product and should not be relied on as a current safety, certification, performance, or availability claim.


If eyewear is ever made purchasable, it should be treated as non-prescription consumer eyewear only unless the exact Product page expressly states otherwise. It should not be assumed to be prescription eyewear, vision-correction eyewear, occupational personal protective equipment, industrial safety glasses, ballistic eyewear, certified sports eye protectors, or certified impact-protection equipment unless the exact Product page identifies the applicable standard or certification.

4. Paddles, balls, grips, bags, lens wipes, and accessories

Use paddles, balls, overgrips, bags, lens wipes, and accessories only for their intended purpose. Do not modify Products, use damaged Products, use Products in unsafe conditions, or use Products contrary to instructions, warnings, sport rules, facility rules, or common safety practices.


Lens wipes and cleaning products should be used only as directed. Avoid contact with eyes, mouth, open wounds, and sensitive skin. Keep wipes, small parts, packaging, straps, and accessories away from children where they may present choking, strangulation, irritation, or other risks.

5. Supervision and minors

Products are sold only to adult purchasers. Adults are responsible for supervising any use by minors and for determining whether a Product is appropriate for a minor's age, size, ability, and activity. Adult supervision does not eliminate risk.

6. No medical, professional, or safety advice

Website content, product descriptions, marketing materials, and customer support communications are for general informational purposes only and are not medical, safety, professional, coaching, legal, or technical advice. Consult an appropriate professional if you have health, safety, equipment, or injury concerns.

7. Product issues and safety complaints

If you believe a Product is defective, unsafe, or has caused injury or property damage, stop using it immediately and contact us with your order number, Product name, batch or label information if available, photos or video, and a description of the issue. We may request additional information to investigate.

8. Product claims and certifications

Do not rely on general marketing, category names, or product appearance as proof that a Product meets a specific safety standard. We do not claim that any Product is shatterproof, unbreakable, injury-proof, ANSI-rated, impact-rated, UV-rated, anti-fog, anti-scratch, certified, or compliant with any specific standard unless that claim is expressly stated on the applicable product page and supported by documentation for that exact Product.

10. Eyewear-specific disclaimer if eyewear is ever made purchasable

Eyewear is not currently offered for purchase if it is displayed as sold out or unavailable. If eyewear is ever made purchasable, then unless expressly stated in writing for that specific Product, the eyewear Product is non-prescription consumer eyewear only and is not prescription eyewear, vision-correction eyewear, safety glasses, industrial safety equipment, occupational personal protective equipment, ballistic eyewear, certified sports eye protectors, or certified impact-protection equipment.


For eyewear Products, any general references to "eyewear," "sports eyewear," "pickleball eyewear," "active eyewear," "durable," "comfortable," or "lightweight" are general product descriptions only. Do not rely on claims such as "UV," "UV400," "polarized," "anti-fog," "anti-scratch," "scratch-resistant," "impact," or similar feature, performance, or safety claims unless the Product page expressly identifies that claim for the exact Product and the claim is supported by documentation for that exact Product.


No eyewear Product can eliminate all risk of eye injury, facial injury, impact, accident, impaired vision, exposure, property damage, or other harm.

11. Care, materials, and allergies

Products may be damaged by improper cleaning, abrasive cloths, harsh chemicals, alcohol, solvents, extreme heat, direct sunlight, pressure, bending, impact, dropping, crushing, moisture, salt water, cosmetics, sunscreen, sweat, oils, improper storage, or other conditions.


Product materials, coatings, finishes, dyes, lenses, frames, nose pads, hinges, screws, packaging, cases, cloths, accessories, and other components may vary by supplier, manufacturer, batch, model, color, or production run.


Products may contain or come into contact with plastics, metals, nickel, rubber, silicone, adhesives, coatings, dyes, cleaning agents, packaging materials, or other substances that may cause irritation, allergic reaction, sensitivity, discoloration, odor, or other reaction in some users.

This Import, Customs, Tariff & Third-Party Fulfillment Notice applies to orders placed through cutawaypoint.com and forms part of our Terms & Conditions and Shipping Policy.

1. Third-party fulfillment model

Products sold by cutawaypoint may be sourced, manufactured, packed, fulfilled, shipped, imported, cleared, transferred, or delivered by third-party suppliers, agents, manufacturers, warehouses, sourcing agents, fulfillment partners, customs brokers, postal operators, logistics providers, carriers, and other service providers. Some parties may be located outside the United States, including China.

2. Shipping origin and routing may vary

Products may ship from a supplier, manufacturer, warehouse, logistics partner, consolidation point, or carrier hub located outside the United States. Shipping origin, route, carrier, delivery method, customs process, and delivery timeline may vary by Product, destination, inventory availability, supplier, tariff rules, carrier conditions, and logistics conditions.

3. Important customs, duties, tariffs, brokerage, and carrier fees

IMPORTANT DUTIES-PAID SHIPPING NOTICE: Eligible orders shipped to the mainland United States are intended to be fulfilled using a duties-paid shipping method. This means standard import duties, import taxes, tariffs, customs processing charges, brokerage fees, carrier collection fees, and similar import charges known to us are intended to be included in the checkout total for eligible orders, unless the product page or checkout clearly states otherwise.


Some Products may ship from outside the United States, including China. For eligible duties-paid orders, standard import duties, import taxes, tariffs, customs processing charges, brokerage fees, carrier collection fees, and similar import charges known to us are intended to be handled through our supplier, logistics provider, customs broker, carrier, or fulfillment route before delivery to the customer.


You should not normally be asked to pay additional standard import-related charges on delivery for an eligible duties-paid order. If a carrier, customs broker, postal operator, or other party requests an unexpected import-related payment, contact us before paying so we can review the issue. We may ask for a copy or photo of the payment request, tracking information, carrier notice, invoice, receipt, or other information needed to investigate.


Duties-paid shipping does not mean that a Product is duty-free, tariff-free, tax-free, customs-free, or exempt from import rules. It means that standard import duties, import taxes, tariffs, customs processing charges, brokerage fees, carrier collection fees, and similar import charges known to us are intended to be handled as part of the fulfillment route for eligible orders.


Duties-paid shipping does not cover costs caused by inaccurate customer information, unsupported addresses, freight forwarding, reshipping, refusal to cooperate with customs clearance, failed delivery, unclaimed packages, remote area charges, optional upgrades, or other circumstances outside standard duties-paid import handling, except where applicable law requires otherwise.

4. Customer information and import issues

You are responsible for providing accurate, complete, current, and deliverable customer information. For eligible duties-paid orders, we, our supplier, logistics provider, carrier, customs broker, or other fulfillment partner may arrange import clearance and related import handling. You authorize us and our fulfillment partners to use the order information you provide for shipping, customs clearance, import processing, delivery, and related compliance purposes. Incorrect or incomplete information may cause customs holds, failed delivery, return-to-sender events, extra charges, delays, or abandonment. We are not responsible for costs or delays caused by inaccurate or incomplete customer information except where applicable law requires otherwise.

5. Law changes and government action

Tariffs, import rules, customs practices, government fees, carrier rules, sanctions, and product restrictions may change without advance notice. If a shipment becomes delayed, restricted, returned, abandoned, refused, assessed with extra charges, or impossible to complete because of customs, tariffs, government action, carrier action, supplier action, or legal requirements, we may handle the issue case by case and will provide any remedy required by applicable law.

6. Product restrictions and safety documentation

Some Products, especially sports-related items, may require supplier documentation, warnings, markings, test reports, certifications, approval records, or country-of-origin information before we make specific claims about them. Eyewear, if displayed on the Website, is intended to remain sold out and unavailable for purchase unless separately approved for sale. 7. No duty-free, tariff-free, tax-free, or customs-free claim

Duties-paid shipping does not mean that a Product is legally duty-free, tariff-free, tax-free, customs-free, or exempt from import rules. It means standard import-related charges known to us are intended to be handled through the checkout total or fulfillment route for eligible duties-paid orders, rather than collected from you at delivery.

9. Customs, forwarding, and unsupported destinations

Eligible mainland U.S. orders are intended to use a duties-paid shipping method unless the product page or checkout clearly states otherwise. Duties-paid shipping does not cover freight forwarding, package forwarding, reshipping, unsupported destinations, customer-caused customs issues, failed delivery, unclaimed packages, remote area charges, optional upgrades, or similar non-standard circumstances, except where applicable law requires otherwise.


If you use a freight forwarder, package forwarding service, reshipper, mail drop, virtual address, hotel, temporary address, parcel locker, third-party recipient, or other non-standard delivery arrangement, you do so at your own risk.


Delivery to the address provided at checkout completes our delivery obligation to the maximum extent permitted by applicable law, even if the package is later lost, delayed, refused, seized, damaged, returned, abandoned, misdelivered, or assessed additional charges after forwarding or transfer.


You are responsible for ensuring that any Product you purchase, receive, forward, export, re-export, resell, transfer, or use is lawful and appropriate for the destination, recipient, activity, and intended use.
